Democrats Introduce GUARDRAILS Act to Void White House AI Preemption Executive Order

Representatives Don Beyer, Doris Matsui, Ted Lieu, Sara Jacobs, and April McClain Delaney introduced the GUARDRAILS Act on March 20, 2026. The bill would repeal the Trump Administration's December 2025 executive order establishing a federal AI preemption framework, stating it "shall have no force or effect" and prohibiting federal funds from being used for its implementation. Senator Brian Schatz introduced companion Senate legislation. The bill was introduced on the same day the Trump Administration released its National Policy Framework for Artificial Intelligence recommending congressional preemption of state AI laws. The Democratic legislation preserves state authority to enforce AI consumer protection and anti-discrimination laws.
